Miami Zofran Birth Defects Attorney
GSK’s anti-nausea/chemo drug prescribed to thousands of pregnant women likely caused thousands of birth defects. GlaxoSmithKline (GSK) first received reports of birth defects associated with Zofran use by pregnant women as early as 1992. Over 200 reports suggest it caused conditions such as cleft lips/palates, congenital heart defects, kidney malformation, and stillbirth. It is believed that the number of reported birth-defects associated with Zofran is just a fraction of all cases. In 2012, GSK was forced to, “plead guilty and pay $3 billion to resolve its criminal and civil liability arising from the company’s unlawful promotion of certain prescription drugs, its failure to report certain safety data, and civil liability for alleged false price reporting practices,” according to the US Department of Justice. On Oct. 23, U.S. District Judge F. Dennis Saylor IV stated, “At least two experts have opined that, based on their fields of expertise, Zofran can cause cleft lip with or without cleft palate.” Though over 200 complaints have linked birth defects to Zofran use by pregnant women, GSK has taken no actions to inform the public or warn of the potential drug-related risks. As a result, the law offices of Viñas & DeLuca, is currently accepting cases involving individuals who have suffered injury or loss due to Zofran use during pregnancy.
